California Financial Code, Division 9, Chapter 3.5 Program Administrators (PACE)

About This Book

California Financial Code, Division 9 (California Financing Law), Chapter 3.5 (Sections 22680–22697) establishes a licensing and regulatory framework for Property Assessed Clean Energy (PACE) program administrators.

Key Provisions

  • Definition & Licensing: Enacted under AB 1284, the law governs entities that administer PACE programs on behalf of public agencies. PACE allows property owners to finance energy-efficiency, renewable energy, and water-efficiency improvements, repaid through property tax assessments. All program administrators must be licensed and overseen by the California Department of Financial Protection and Innovation (DFPI).

  • Solicitor Training: Administrators must establish and maintain DFPI-approved training programs for PACE solicitors and solicitor agents who interact with consumers.

  • Registration & Oversight: Administrators must notify the DFPI of each enrolled solicitor and solicitor agent, and maintain books, records, and accounts accessible from their principal California location.

  • Consumer Complaints: Administrators must implement formal policies and procedures to address consumer questions and complaints as soon as reasonably practicable.

  • Examination Authority: Under Section 22690, the DFPI commissioner may inspect, examine, or investigate program administrators, solicitors, and solicitor agents—including reviewing records and compelling witness testimony—to prevent fraud or statutory violations.
