The Pennsylvania Real Estate Licensing and Registration Act (RELRA) serves as the foundational law governing the real estate industry in Pennsylvania. Administered by the State Real Estate Commission, it establishes consistent standards for licensing, continuing education, and consumer protection.
The Act is built on four key pillars:
Licensing Requirements: RELRA requires aspiring real estate professionals to complete 75 hours of pre-licensing education — 30 hours in real estate fundamentals and 45 hours in practice — and pass the state licensing exam. Licenses are issued across three categories: brokers, associate brokers, and salespersons.
Wholesaling Regulations: The Act was amended to bring real estate wholesaling under the legal definition of brokering. As a result, wholesalers are now required to hold a valid license, provide written disclosures to all parties, and offer sellers a 30-day right to cancel any agreement.
Consumer Protections and Disclosures: RELRA outlines the information agents must disclose during initial client interviews, establishes rules for the proper handling of client funds held in escrow, and requires the disclosure of any conflicts of interest that may arise during a transaction.
Prohibited Conduct: The Act grants the State Real Estate Commission the authority to investigate complaints and take disciplinary action — including fines, suspension, or license revocation — against licensees found guilty of unethical behavior, misrepresentation, or violations of their fiduciary duties.
