3 questions

Sample 1 — Texas Agency and Brokerage

Question: A seller signs an exclusive listing agreement with your sponsoring broker. Under TRELA, which service is part of the statutory minimum the broker must provide that seller?

  • A. Preparing a comparative market analysis of the property
  • B. Advertising the property in a multiple listing service
  • C. Attending the closing with the seller
  • D. Answering the seller's questions and presenting offers

Correct Answer: D

Section 1101.557(b) provides that a broker who represents a party or lists real estate under an exclusive agreement must inform the party of material information, including receipt of an offer, and shall, at a minimum, answer the party's questions and present any offer to or from the party. CMAs, MLS advertising, and closing attendance are negotiated services, not statutory minimums.

Sample 2 — Texas Standards of Conduct

Question: The Canons of Professional Ethics and Conduct list the bases on which a license holder may not indicate a preference, limitation, or discrimination. All of the following are listed bases EXCEPT:

  • A. marital status
  • B. national origin
  • C. familial status
  • D. ancestry

Correct Answer: A

22 TAC §531.19(a) lists race, color, religion, sex, national origin, ancestry, familial status, and disability. Marital status is not among the bases listed in this Canon.

  • A. 3 days
  • B. 10 days
  • C. 20 days
  • D. 7 days

Correct Answer: A

Paragraph 4C(2) of TREC No. 20-19 provides that if the seller has not delivered copies of all Natural Resource Leases, the seller shall provide them to the buyer within 3 days after the Effective Date, and the buyer may terminate within the negotiated number of days after receiving them, with the earnest money refunded.
